Tricon Broadband Equipment Limited Warranty

As part of your Tricon Broadband subscription, you may receive several pieces of equipment from Tricon Broadband. Depending on your type of service, you may receive a Fiber Jack, Network Box or Network+ Box, Tricon WiFi device, Storage Box, TV Box and Remote Control, Phone Box, and/or other equipment.

Some equipment, like the Fiber Jack, and certain Tricon WiFi devices, are provided to you as part of the services, are owned by Tricon Broadband, and are not covered by this Limited Warranty.

Other pieces of equipment, including Nest devices, and the NVIDIAⓇ SHIELD™ TV streaming box, are also not covered by this Limited Warranty, because they are covered by warranties provided by their respective manufacturers. Please refer to the warranty card in the packaging of that equipment or contact the manufacturer for the warranty terms and how to make a claim.

Finally, sometimes equipment is made available for you to purchase directly from Tricon Broadband. We call this “Tricon Broadband Equipment You Own.” This category may include, for example, certain Tricon WiFi devices (including Tricon WiFi devices purchased before April 15, 2020), TV Box and Remote Control if you choose to purchase them.

Tricon Broadband warrants the Tricon Broadband Equipment You Own against defects in materials and workmanship under normal use for two years from the date you receive the Tricon Broadband Equipment You Own from Tricon Broadband. Tricon Broadband warrants Tricon WiFi devices purchased on or after April 15, 2020 against defects in materials and workmanship under normal use for one year from the date you receive the Tricon WiFi device from Tricon Broadband.

This Limited Warranty is only valid and enforceable in cities where Tricon Broadband makes its services available. This Limited Warranty will not apply if you acquire the Tricon Broadband Equipment You Own from a party other than Tricon Broadband. This Limited Warranty only applies to hardware components. Tricon Broadband does not provide any warranty for damage caused by normal wear and tear, accidents, misuse (including failure to follow product documentation), neglect, disassembly, alterations and external causes such as but not limited to extreme thermal or environmental conditions. This Limited Warranty does not guarantee that use of the Tricon Broadband Equipment You Own will be uninterrupted or error free.

EXCLUSIVE REMEDY FOR TRICON BROADBAND EQUIPMENT YOU OWN: If a defect arises during the two-year warranty period, you may return the defective Equipment You Own to Tricon Broadband. Tricon Broadband will, in its sole discretion and to the extent permitted by law, either repair the defective Tricon Broadband Equipment You Own using new or refurbished parts or replace the defective Tricon Broadband Equipment You Own with new or refurbished equipment with functionality at least equivalent to the defective equipment. If Tricon Broadband repairs or replaces any Tricon Broadband Equipment You Own, the repaired or replaced equipment will continue to be covered by this limited warranty for the remaining part of the original warranty period. Equipment and parts that have been replaced will become the property of Tricon Broadband.

To make a warranty claim, please contact Tricon Broadband support. In order to qualify for the warranty benefits described above, you must provide your name, contact information, subscriber information and the serial number of the relevant Equipment You Own.

THE LIMITED WARRANTY WRITTEN ABOVE IS THE ONLY EXPRESS WARRANTY TRICON BROADBAND PROVIDES FOR THE TRICON BROADBAND EQUIPMENT YOU OWN, AND THE ABOVE REMEDIES ARE YOUR ONLY REMEDIES. EXCEPT AS EXPRESSLY SET FORTH ABOVE AND TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRICON EXPRESSLY DISCLAIMS ALL OTHER WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER STATUTORY OR IMPLIED, REGARDING THE EQUIPMENT YOU OWN.

Some States do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRICON BROADBAND AND ITS SUBSIDIARIES AND AFFILIATES (COLLECTIVELY, “TRICON PARTIES”) SHALL NOT BE LIABLE TO YOU UNDER ANY THEORY OF LIABILITY (WHETHER CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE) FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES THAT MAY BE INCURRED BY YOU IN CONNECTION WITH THE TRICON BROADBAND EQUIPMENT YOU OWN OR THESE TERMS, INCLUDING ANY LOSS OF DATA, WHETHER OR NOT A TRICON PARTY OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING. YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TRICON PARTIES’ TOTAL LIABILITY IN CONNECTION WITH THE EQUIPMENT YOU OWN OR THE LIMITED WARRANTY ABOVE WILL NOT EXCEED THE REPLACEMENT VALUE OF THE EQUIPMENT YOU OWN.

Some States do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

No employee or representative of Tricon Broadband or its affiliates or any third party is authorized to make any modification, extension or addition to this Limited Warranty. If any term of this Limited Warranty is held to be illegal or unenforceable, the remaining terms of this Limited Warranty will remain in full force and effect. This warranty gives you specific legal rights, and you may have other rights which vary from State to State.
